Training legislation

Vocational education and training (VET), in Australia is regulated by a variety of Commonwealth, State and Territory laws.

Employment, workplace and equity issues are also covered by a range of Commonwealth, State and Territory legislation.

According to the Australian Constitution, where State and Territory laws and the Commonwealth laws deal with the same situation inconsistently, the Commonwealth law prevails.

VET legislation

Tasmania has laws which govern VET. The Tasmanian Vocational Education and Training Act 1994:

  • Establishes and grants powers to Skills Tasmania and the Tasmanian Training Agreements Committee.

  • Provides the legislative authority for the administration of apprenticeships, traineeships and vocational placements

  • Contains provisions regarding inquiries, inspections and disputes

Tasmanian Qualifications Authority Act 2003: Deals with accreditation and registration matters for higher education, senior secondary education and vocational education and training.
