The Apprenticeship/Traineeship Training Contract is used in all States and Territories and is a legally binding agreement between you and your apprentice or trainee. It protects both you and your employee’s interests and outlines your obligations.
The Training Contract must be fully completed by the employer, the apprentice/trainee, and a parent or legal guardian if the apprentice/trainee is less than 18 years of age.
The Training Contract contains:
- the duration of the Training Contract
- details of the registered training organisation (RTO) which will deliver the training
- industrial arrangements under which the apprentice or trainee will be employed
- the qualification to be obtained by the apprentice or trainee
- employment arrangements, for example full-time or part-time.
Probation period
A probation period applies to apprentices/trainees undertaking training under an approved training contract as follows:
- If the apprenticeship or traineeship is less than 24 months in duration, the probationary period is one month. For all other apprenticeships and traineeships the probationary period is three months.

Any changes to the Training Contract such as a transfer, suspension or cancellation, will not take affect until it is approved by the Tasmanian Training Agreements Committee. In all cases where changes to the Training Contract are required, the employer’s nominated Australian Apprenticeships Centre (AAC) should be consulted for advice.

Cancellation
Applications to cancel by mutual consent should be coordinated by your AAC - an apprentice/trainee cannot be forced to cancel a training contract with their employer.
Suspension
Apprenticeships and traineeships can be suspended due to:
- lack of work
- medical/personal reasons
- disciplinary action
Applications to the Tasmanian Training Agreements Committee must be made in writing, stating reasons, period of suspension and operative date requested. Applications should be coordinated by your AAC.

Transfer
A Training Contract can be transferred from one employer to another providing that all parties agree, and subject to approval by Tasmanian Training Agreements Committee. Transfers should be coordinated by your AAC.
The RTO responsible for providing the formal training for the apprenticeship or traineeship should be contacted regarding the transfer. If the RTO is not in a position to continue to deliver the formal training as a result of the transfer a new RTO must be selected.
Variations to the Training Contract
The employer and apprentice/trainee can apply to have their training contract varied. All parties must agree to the variation. Variations to the Training Contract may include requests for:
- an amendment to the term of the contract
- a different qualification
- a change to the legal name of the employer
- a change to the type of employment arrangement.
- a different RTO
Any request to vary a Training Contract should be coordinated by your AAC. The request needs to be made in writing and signed by all parties. Any changes will not take affect until it is approved by the Tasmanian Training Agreements Committee.
